The
Importance of a Successful Trade Compliance Program
As
of July 2008, the Department of Defense issued an interim rule,
amending the Defense Federal Acquisition Regulation Supplement (DFARS)
to address compliance with export laws and executing Government
contracts. In effect, not only can a violation of export laws
and regulations result in severe monetary penalty, loss of
exporting privileges and possible jail time, it can now also
result in a breach of the Government contract. |
As
a result of this amended rule, government prime
contractors are flowing down the requirement to comply will all
export regulations, by requiring all subcontractors to
register with the DDTC and
to have an export
compliance program in place.

Did
you know...
Did
you know that an export by definition is more than just shipping
a physical item outside the United States? An export can be the
transferring of information via phone call, email, facsimile,
plant tour, or a conversation with a foreign person whether in
the United States or abroad. With this information in mind,
answer the following questions:
-
Do you have policies and
procedures in place to prevent the transfer of controlled
articles and technical data to foreign persons?
-
Do you know if your products are
controlled by the Department of State or the Department of
Commerce?
-
Do you have a proper
recordkeeping and reporting system in place?
-
If you have
foreign persons employed at your facility, do you know
what the procedures and regulations are and the potential
impact is?
If you
answered "no" to any of the above questions, contact us to
discuss the ways we can help you gain control over your exports
and move confidently in the international market.
